2 Garrett Opposes Higher Health Insurance Premiums for AmericansRep. Scott Garrett (R-NJ) released the following statement regarding H.R. 2626, the Health Insurance Industry Fair Competition Act:

The American people are tired of the politics of the health care debate. Americans want reform, not rhetoric. I agree with the constituents of the Fifth District of New Jersey that health care is too expensive and that prohibitively high cost can limit access for many families within my district and across the United States.

One of the main components that I believe needs to be included in health care reform is the ability for individuals to buy insurance plans across state lines. The legislation considered by the House of Representatives today, the Health Insurance Industry Fair Competition Act would in no way address the right of individuals to shop for a plan in a different state, and despite its name, would not actually promote fair competition within the health insurance industry.

In reality, this legislation would create more legal and regulatory uncertainty, which could lead to increased litigation and higher costs passed on in the form of higher premiums for American families, a point which is supported by the nonpartisan Congressional Budget Office. Additionally, this legislation may have a negative effect on competition by prohibiting new entrants to the market and smaller insurance businesses from gaining access to enough information to accurately trend, forecast, rate or price. Finally, this legislation also has the potential to prohibit or curb new industry initiatives aimed at improving quality and efficiency while reducing costs such as data aggregation, administrative simplification, and quality measurement.

2 Constitutionality of the Health Insurance Mandate, video 1The healthcare bill requires individuals to purchase federally approved health insurance plans.

This is an unprecedented regulation which marks the first time in history that Congress has required individuals to purchase a good or service.

While Congress since the New Deal has been given broad powers under the commerce clause, this regulation is different is that it doesn’t regulate interstate commerce so much as it mandates that commerce take place. This does not fall within the three prongs of the Lopez test (US v. Lopez), and is therefore not a valid exercise of the Commerce Clause power.

2 President Bush Discusses Health Care InitiativesTHE PRESIDENT: I just had a very interesting discussion with people who are deeply concerned about the status of health care in America today. These men and women around the table are charged with designing products for businesses, both large and small, and individuals.

And I discussed my health care plan that would allow — would equalize the tax code so that the individual would be more likely to be able to purchase a plan, because I believe a good health care system is one that rewards the consumer, encourages the consumer, and makes sure the consumer has got the capacity to make viable choices. And when you have consumers in charge of their health care decisions, it is a force that is likely to keep the health care costs down.

Bush meets with members of the nation’s health insurance industry Tuesday, Feb. 20, 2007 in the Roosevelt Room at the White House, to discuss the effect of the President’s health care proposals on the individual health insurance market. And I thank you very much for your insights and your concerns about the current — the state of health care today in America.

I have the duty to talk to the American people about what I think will be a better alternative than one in which the federal government makes the health care decisions for the patient and the provider. And I laid out such a plan in my State of the Union.

And now, I call upon members of the Congress to analyze this plan very carefully, to recognize the best decisions are made between the patients and their providers, and to work with the administration in a bipartisan fashion to make sure that health care is accessible and affordable for as many Americans as is possible.

We have a duty here in Washington to take care of the poor, the disabled, and the elderly, and we’re meeting that duty. And now we have a duty to make sure the health care system is responsive to the American people. And I look forward to working with Democrats and Republicans to do just that.
